NYIT is prohibited under federal law from making false, erroneous, or misleading statements, directly or indirectly, to a student, prospective student, member of the public, accrediting agency, state agency, or to the U.S. Department of Education.
Definitions
Misleading statements are those that have the likelihood or a tendency to deceive or confuse the person to whom they are made.
A statement is any communication whether it is made in writing, visually, orally, or through any other means of communication.
Misrepresentation is any direct or indirect false, erroneous or misleading statement made by the institution or one of its representatives or servicers.
Substantial misrepresentation is misrepresentation on which a person could reasonably be expected to rely, or has reasonably relied, to that person’s detriment.
Assurance
NYIT does not provide false, erroneous or misleading statements concerning: the nature of its education program, the nature of its financial charges, or the employability of its graduates.
In an effort to clarify the institution’s commitment to practicing personal and academic integrity and ethical behavior, the following procedures are utilized to avoid any misrepresentations about key NYIT functions and programs.
Procedure
NYIT strives to provide accurate, honest and clear information in print, online, broadcast media and oral presentations to all audiences. Training of employees to avoid any form of misrepresentation as they disseminate communications is a key component of this procedure.
To enable institution-wide compliance with this policy, each department should work with the Strategic Communication in the creation and dissemination of all materials. This office will assist departments in ensuring all information is reviewed for accuracy and clarity.
In addition, the Office of Research, Assessment, and Decision Support is responsible for calculating, maintaining, and providing accurate and timely information for departments at key junctures during the academic year regarding a variety of key institutional data. NYIT employees should ensure any information provided is consistent with data from this office, where applicable.
Finally, directors of operational units are responsible for the training of personnel regarding misrepresentation of information about the institution or its programs or services.
Reporting
Each member of the NYIT community is responsible for assuring that the actions and activities conducted at the institution promote an environment consistent with this policy. This includes the responsibility to report, for appropriate review, actions or activities that concern any suspected false, erroneous or misleading statements.

Disciplinary Action
The university considers violations of this policy as serious offenses and will take disciplinary action appropriate to the nature and extent of the violation to ensure that violations are not repeated.
