Purpose:
The purpose of this policy is to set forth the circumstances in which it is permissible for staff members to hold a second assignment within the university, and to establish the framework for doing so.
Scope:
This policy applies to all New York Tech staff members employed by the university including, full-time, part time, and temporary staff.
Definitions:
- Second Assignment: Any additional position that a staff member undertakes within the university outside of their primary position and responsibilities, and, in the case of full-time employees, for which they will be compensated in addition to their base salary. An employee whose primary job duties include more than one function, for example lab technicians who also teach lab courses, or staff whose job description includes teaching a course as part of their base salary, are not considered as having a "second assignment."
- Primary Position: the position within the university which is a full-time staff member's main role and primary job duties, and is compensated by the employee's base salary, and for part-time employees is their first position held.
Policy
The rules below are different for exempt and non-exempt staff because of federal wage and hour regulations requiring overtime for non-exempt staff. - Exempt full-time staff in good standing in their primary position and who meet the experience and educational requirements to teach are eligible to apply and be considered for a second assignment as an adjunct faculty member. The staff member must have their supervisor's approval, in writing each academic term, prior to applying for or agreeing to the assignment. The adjunct duties, including teaching, preparation, grading, and work on online courses may not be conducted during the staff member's regular work hours. Exempt staff are generally not eligible to hold a second assignment other than adjunct teaching. Exceptional circumstances may be discussed with the Office of Human Resources.
- Non-exempt full-time staff are not eligible to hold second assignments. Limited exceptional cases may be discussed with the Office of Human Resources.
- Non-exempt part-time or temporary staff in good-standing with their primary position are permitted to hold one or more additional non-exempt part-time or temporary assignment, provided that their total hours for all assignments must not exceed 20 hours per week. All non-exempt part-time and temporary staff must be compensated on an hourly basis for all assignments, and total hours among assignments will be accumulated to determine applicable straight or overtime.
To be considered in "good standing" the staff member must have completed six months of continuous employment, have satisfactory performance in their primary position, have had no disciplinary actions or performance issues in the prior six months, and not be currently under investigation by the university for alleged misconduct or policy violations.
Procedures
Staff members who are interested in holding a second assignment must first receive written approval from their supervisor before applying for an opportunity. A supervisor's approval is granted on a case-by-case basis in accordance with the provisions outlined in this policy. For staff members who are eligible for an adjunct faculty position, the supervisor's approval will be granted on an academic term basis and must be re-requested each term the staff member wishes to serve as an adjunct. Approval is at the sole discretion of the supervisor, and any exceptions to this policy, including teaching during regular work hours, must be approved by the Provost or applicable Vice President. If the staff member is approved to teach as an adjunct, supervisors will notify Academic Affairs and Human Resources.
Any staff member found to be in violation of this policy as outlined may be subject to disciplinary action.
